Tesla argues that similar cases filed by California’s Civil Rights Department (CRD) and a proposed class action by Tesla workers should be resolved before the federal lawsuit proceeds.
EEOC allegations and timing concerns
The EEOC lawsuit contends that Black workers at Tesla’s Fremont plant endured racist slurs, graffiti, and faced retaliation for complaints from 2015 to the present. Tesla challenges the timing of the EEOC’s lawsuit, asserting it was hurriedly filed as part of a competitive dynamic with California’s CRD, which had made similar claims in 2022.
Parallel cases in state court
The CRD’s lawsuit and the proposed class action by Tesla workers, both pending in state court, accuse Tesla of tolerating discriminatory conditions and bias against Black employees in various aspects of employment, including pay, promotions, and work assignments. These cases, based on California anti-discrimination laws, run parallel to the federal lawsuit’s distinct claim under federal law.
Tesla’s argument for delay
